01Agreement to these Terms
These Terms of Use (“Terms”) are a binding agreement between you and Superstar Wellness (“Superstar Wellness,” “we,” “us,” or “our”) governing your access to and use of superstarwellness.ai (the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old to use the Site.
02What this Site is
The Site provides general information about Superstar Wellness and its family of brands, including FutureSelf RX and AuraStar RX. Superstar Wellness is a technology and services company. It is not a healthcare provider, pharmacy, health plan, or insurer, and the Site does not offer medical services.
Each brand's products and services are offered on that brand's own website and are governed by that brand's own terms, privacy policy, and consents, which control if they conflict with these Terms. For example, FutureSelf RX services are subject to its Terms of Service, Privacy Policy, and Telehealth Consent.
03Medical disclaimer
Content on the Site is for general informational purposes only and is not medical advice, a diagnosis, or a prescription, and does not create a provider-patient relationship. Always seek the advice of a qualified, licensed clinician about any medical condition or treatment.
Where our brands facilitate telehealth, care is provided by independent licensed clinicians who make their own clinical decisions. A prescription is never guaranteed and is issued only if a clinician determines it is appropriate. Prescription products are dispensed by licensed U.S. pharmacies. Compounded medications are not approved by the U.S. Food and Drug Administration (FDA), and the FDA does not verify their safety, effectiveness, or quality before they are marketed. Individual results vary.
If you think you may be experiencing a medical emergency, call 911 or go to the nearest emergency department. Messages sent through the Site are not monitored for emergencies.
04Communications
If you submit a contact form or join our email list, you agree that we may contact you by email about your inquiry and, for list subscribers, about our brands and launches. You can unsubscribe from marketing emails at any time. Do not submit medical information through the Site.
05Acceptable use
You agree not to: use the Site for any unlawful purpose; submit false information or impersonate anyone; interfere with or disrupt the Site or its security; scrape, copy, or harvest content or data by automated means without our written permission; or attempt to gain unauthorized access to any system or account.
06Intellectual property
All content on the Site, including text, images, graphics, logos, the Superstar Wellness name and star mark, and the names and marks of our brands, is owned by Superstar Wellness or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial purposes. No other rights are granted.
07Third-party sites
The Site links to other websites, including our brands' sites and third-party services. We are not responsible for the content, policies, or practices of third-party sites, and your use of them is at your own risk and subject to their terms.
08Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE MAKE NO REPRESENTATIONS REGARDING THE SAFETY, EFFICACY, OR OUTCOMES OF ANY PRODUCT OR SERVICE DESCRIBED ON THE SITE.
09Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUPERSTAR WELLNESS AND ITS AFFILIATES, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
10Indemnification
You agree to indemnify and hold harmless Superstar Wellness and its affiliates from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
11Governing law and disputes
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association, conducted in Wyoming or by video conference, except that either party may bring an individual claim in small-claims court where eligible or seek injunctive relief to protect intellectual property. You and Superstar Wellness each waive any right to a jury trial and to participate in a class or representative action. Nothing in this section prevents you from filing a complaint with a government agency.
12Changes and general terms
We may update these Terms by posting a revised version and updating the date above; continued use of the Site after changes means you accept them. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.
